Construction Industry Payment and Adjudication Act 2012 (CIPAA)
What is CIPAA 2012?
It refers to the Construction Industry Payment and Adjudication Act 2012 ("CIPAA" or the "Act") been gazetted since 22 June 2012. CIPAA is also accompanied by the Construction Industry Payment and Adjudication (Exemption) Order 2014 (the "Order") and the Construction Industry Payment and Adjudication Regulations 2014 (the "Regulations").
It is an act to facilitate the resolution of dispute relating to payment. The concept is ‘Pay Now…and Argue Later’ aimed to resolve ‘cash flow starvation’ problem in the construction industry.
CIPAA 2012 Covers
* Every construction contract made in writing relating to construction works carried out wholly or partly within territory of Malaysia including a construction contract entered into by the Government.
* Construction Contract includes construction work contract or construction consultancy contract
* Construction Works means the construction, extension, installation, repair, maintenance renewal, renovation, alteration, dismantling or demolition.

Mr. Yang Tek Yeh
Chartered Arbitrator, Adjudicator and an Advocates & Solicitors of the High Court of Malaya.
Mr. Yang Tek Yeh holds a Masters Degree in Commercial and Corporate Law from Queen Mary & Westfield College, University of London. He was called to the English Bar and admitted as Utter Barrister of Lincoln’s Inn in 1993 and called to the Malaysian Bar the following year and duly admitted as an Advocates & Solicitors.
He is currently Managing Partner of Messrs Aziz & Co and acted as counsel for clients in arbitration, adjudication and courts matter.
